These Terms and Conditions govern your use of our services, including tours, excursions, transportation, and related offerings. By booking with us—via phone, email, website, or third-party platform—you agree to be bound by these terms. Please read them carefully.

1. Booking & Confirmation

• All bookings require a deposit of 40% (or full payment for day trips/short tours) to confirm.
• Final payment is due 7 days prior to tour start date (unless otherwise agreed in writing).
• Bookings are confirmed only upon receipt of deposit and written/email confirmation from Koutoubia Tours.
• Provisional reservations (held without deposit) expire after 48 hours.

2. Pricing & Payments

• Prices are quoted in Moroccan Dirhams (MAD) or EUR/USD (as specified) and include all items listed under “Includes” in the tour description.
• Prices are subject to change due to fuel surcharges, government taxes, or unforeseen cost increases beyond our control. Any adjustment will be communicated promptly.
• Accepted payment methods:
  • Bank transfer (preferred)
  • Cash (MAD/EUR/USD) upon pickup
  • PayPal or Wise (with 3% processing fee)
• No hidden fees—what’s quoted is what you pay (unless optional extras are selected on-site).

3. Cancellation & Refunds

• Free cancellation up to 7 days before tour start date: full deposit refunded.
• 4–6 days prior: 50% of deposit forfeited.
• < 72 hours prior or no-show: 100% of deposit forfeited.
• Day trips & half-day tours: Free cancellation up to 24 hours before pickup; after that, 100% non-refundable.
• Group bookings (6+ guests): Require 14 days’ notice for full refund eligibility.
• Force Majeure (e.g., extreme weather, political unrest, natural disaster): Full refund or rescheduling at no cost.

4. Changes & Customization

• Itinerary adjustments (dates, activities, hotels) are welcome and often possible—subject to availability and potential price revision.
• Major changes (e.g., adding/removing destinations, extending duration) may incur administrative fees (10% of adjusted tour cost).
• We reserve the right to modify itineraries for safety, road conditions, or unforeseen closures (e.g., monument strikes, weather). Alternatives of equal value will be provided.

5. Responsibilities

Koutoubia Tours Will:

• Provide qualified, licensed drivers and English/French-speaking guides.
• Use well-maintained, insured, air-conditioned vehicles.
• Include all services as listed in the confirmed itinerary.
• Offer 24/7 support during your tour (via WhatsApp/phone).

Client Responsibilities:

• Carry valid travel documents (passport, visas if required).
• Disclose medical conditions, mobility limitations, or dietary needs at time of booking.
• Follow guide/driver instructions for safety (e.g., seatbelt use, desert conduct).
• Respect local customs: dress modestly (shoulders/knees covered in villages, mosques, and rural areas), ask before photographing people.

6. Liability & Insurance

• Koutoubia Tours holds full commercial liability insurance for transport and guided activities.
• We are not liable for:
  • Personal injury, loss, or damage due to client negligence or non-compliance with instructions.
  • Delays or cancellations caused by airlines, weather, strikes, or government actions.
  • Lost/stolen personal belongings (including cameras, phones, passports).
• We strongly recommend travel insurance covering medical emergencies, trip cancellation, and baggage loss.

7. Children & Special Needs

• Children under 6 years: Free for most day trips (seating subject to availability); discounts apply on multi-day tours.
• Children 6–12 years: 20–30% discount (varies by tour).
• Families: Child seats available upon request (free of charge).
• Guests with reduced mobility: Please inform us in advance—we’ll advise on suitability and accessibility.

8. Intellectual Property & Media

• Photos/videos taken by Koutoubia Tours staff may be used for promotional purposes (website, social media).
• If you prefer not to be featured, please notify your guide at the start of the tour.
• You are welcome to photograph landscapes and public spaces—but always ask permission before photographing people, homes, or religious sites.

9. Governing Law & Disputes

• These Terms are governed by the laws of the Kingdom of Morocco.
• Any dispute not resolved amicably will be subject to the exclusive jurisdiction of the courts of Marrakech, Morocco.
